These general conditions ("the conditions") apply to:

2. ORDERING

The products on our website, offer an offer to buy OCaftan items based on the data provided on our website.

All prices shown are in Moroccan Dirhams, inclusive of VAT. Orders and deliveries are possible in most countries. If OCaftan is not able to process your order, OCaftan will inform you as soon as possible. Orders are accepted as part of a household's consumption (reasonable quantities). When you place an order, we will send you an order confirmation by email. However, this does not mean that your order has been accepted. The order is accepted once the shipment is confirmed by email. (Object of the mail: "order shipment Confirmation").

Our items on the site are stocked and ready to ship. All sizes out of stock are notified unavailable on our site. There may be inventory issues if multiple customers attempt to order the same item at the same time. If we are unable to send you an item that has already been ordered, we will cancel it and you will be refunded or not charged, depending on your payment method. We strive to have a good level of stock. Sometimes errors can occur. Our collections are updated regularly, we invite you to consult our collections regularly. If you place an order in error or wish to cancel it before delivery, thank you to contact us immediately at OCaftan customer service. OCaftan will do everything possible to help you. OCaftan strives to process orders as soon as possible, so a very limited time to cancel your order.

Please note that no changes are possible once the order is placed (address, size, quantity and color).

Orders are processed subject to available stocks. We reserve the right to refuse your order without explicit reason. We also reserve the right to cancel your order by informing you by email, in the following cases, we will only reimburse the amount of the order or the canceled item. Any additional charges on your part, can not be refunded:

  • Your billing information is not correct or unverifiable;

3. PAYMENT

You can pay the products through PayPal or other means available in your country.

The maximum amount you can spend on an order depends on the payment method you select. Contact us for more information.

If you have a promotional code, enter it on the shopping cart page, in the Promotion Code field, and click Apply. Please check the expiry date of your promotional code before using it. NB: You can not use more than one promotional code for the same purchase. Caution: If you use promotional codes for sale products and the total discount is more than 50% of the original price, the promotional code may not be applicable. Each promotional code is valid for one use only, unless otherwise agreed.

  • Checks

During the payment process, OCaftan can carry out credit checks. Depending on the results of these checks, OCaftan can modify, adapt or refuse an order and / or the selected payment method. In most cases, OCaftan will allow you to select a different payment method. Our Customer Service will not be informed of the results of the credit checks.

  • Your total price

The total price indicated on the final checkout page includes taxes and delivery charges. This price will be mentioned in the order confirmation. If you pay by credit card, the full amount of your order will appear on your bank statement.

  • Price changes

The products prices are as displayed on the Website. Prices may vary at any time but changes will not affect any order confirmed in the Order Confirmation.

4. DELIVERY

In principle, the delivery time depends on the type of delivery you have chosen.

If your purchase exceeds the threshold applicable on delivery in your country , you will receive a free "standard delivery" or you can choose a "express delivery" at a reduced price. For more information, you can contact us via the contact us page on our website.

If the delivery time is not respected, we invite you to let us know as soon as possible by email at contact@ocaftan.com. You will give us additional time to identify the reason for the delay and to respond appropriately. In all cases, if late delivery that is not due to an event of force majeure, and if the delivery does not occur within the additional time, you can cancel your order by email to contact@ocaftan.com. You will receive a refund within a maximum of fourteen (14) days from the receipt of your request canceling the order.

If the delivered products have obvious material defects or production defects, including damage during transport, please notify us immediately by email or telephone. The absence of notification doesn't make you lose the benefit of your rights under the law.

5. RESERVATION OF PROPERTY

The products remain the property of OCaftan until full payment.

6. REFERRAL AND CANCELLATION

  • Return of defective products

You can return delivered products that are defective or non-compliant with your order. To do this, you have 48 hours from the date of your order receipt to return the defective product (s) (date as per postmark). If your claim is justified, the purchase price and shipping costs will be refunded.

  • Exercise of your right of return (withdrawal)

All products purchased on our Website may be returned, for whatever reason and without any penalty, within the following deadline, the return costs remaining your responsibility: within 48 hours of the date you (or a third party designated by you other than the carrier) have taken possession of the product (s). If your order contains more than one product, the 48-hour period in which you can change your mind runs from the date that you (or a third party designated by you other than the carrier) physically take possession of all products. You must give us your decision before the expiry of the said period. You must inform us of your intention to return the product (s) following the instructions below, and physically return the product (s) to us as soon as possible and later within 48 hours of your decision to exercise your right of return. If you return the products to us by post, you will have to return them in due time if you have delivered them to the postal services or to the carrier within the 48 hours mentioned above.

If you cancel your order, we will refund all payments we have received from you, including standard delivery charges and administrative fees (if applicable), as soon as possible and always within 14 days of the date to which we have been informed of your decision to return products. However, we may refuse the refund until we have received the products or until you have provided proof of their return. NB: Products you have purchased online can not be returned to OCaftan stores in your area and vice versa. Be careful not to return products from multiple orders in a package, to ensure you receive your refund as soon as possible.

Products must be returned to their original state with their original label. We will not accept or refund products that have been worn or washed. If the products are damaged as a result of intense use, we reserve the right to return them to the shipper.

In addition, we remind you of the existence of a legal guarantee of products conformity under Moroccan code of consumption.

  • How to exercise your right of withdrawal

  • Exchange

OCaftan does not offer an exchange service. If you want another product, another color or another size, please place a new order.

  • Refunds

When the products you have returned have been checked and inspected in our warehouse, you will receive a refund notification by email if a refund is granted.

Note that OCaftan does not provide a cash refunds for returned items. We will send you by email a credit usable for 3 months on our website. Beyond this period, we could no longer accept an order with this credit. You will then receive a refund with a credit equal to your order within a maximum period of fourteen (14) days from the receipt of your request to cancel the order. In order to obtain a full refund, it is important that we receive the returned products in their original conditions: the returned products must be complete, not have been worn or washed, and all their labels must be intact.

7. PROMOTIONAL OFFERS

Promotional offers (promotional codes) of OCaftan are limited to one per customer and per order. It is not possible to combine promotional codes.

2. AMENDMENTS TO THESE TERMS

If OCaftan decides to change these terms and conditions, the changes will be posted on the website. We advise you to regularly check any changes. These conditions were last modified in October 2019.

3. APPLICABLE LEGISLATION AND COMPETENT JURISDICTION

Without prejudice to the mandatory rules of the law of your residence place, these general conditions are governed by Moroccan law, excluding the Vienna Convention on Contracts for the International Sale of Goods. Without prejudice to the rights you have under the law to bring an action in the courts of your residence place, the competent court of Agadir, Morocco, will have sole jurisdiction to settle any dispute related to these general conditions, without prejudice the right to appeal and appeal to the Supreme Court.
